What Is an EIN and Why You Need One

An Employer Identification Number (EIN) is a nine-digit number issued by the IRS that identifies your business for tax purposes. Think of it as your LLC's equivalent of a Social Security Number. It is formatted as XX-XXXXXXX.

You need an EIN to:

  • Open a US bank account — every bank requires an EIN, no exceptions
  • Sign up for Stripe, PayPal, or any US payment processor
  • File your annual Form 5472 (mandatory for all foreign-owned LLCs)
  • Hire employees if you ever employ US-based staff
  • Open business accounts with US vendors, SaaS platforms, and suppliers

Without an EIN, your LLC exists on paper but cannot do anything. It is the single most important number your business will receive after formation.

Why the Online Application Does Not Work for Non-Residents

The IRS offers an online EIN application that issues an EIN in minutes. It is free and fast. There is one problem: it requires either a Social Security Number (SSN) or Individual Taxpayer Identification Number (ITIN) for the responsible party.

Most non-US residents have neither. If you are a foreign national who has never worked in the US, you almost certainly do not have an SSN. ITINs are available but require a separate application (Form W-7) that itself takes 7-11 weeks to process.

This means the online application is effectively blocked for most non-residents. The IRS acknowledges this and provides alternative methods: phone, fax, or mail.

Do not use a fake SSN

Some formation services suggest entering a random number or "000-00-0000" on the online application. This will be rejected or, worse, flagged for fraud. The IRS cross-references SSN and ITIN databases. Use the legitimate phone method instead.

The Phone Method: Step by Step

The IRS operates a dedicated phone line for international EIN applications. This is the fastest and most reliable method for non-residents.

  • Prepare your Form SS-4

    Download IRS Form SS-4 and complete it with your LLC details. Key fields: LLC name, mailing address (your registered agent address), type of entity (LLC), reason for applying ("started new business"), principal activity, and responsible party information (your name and foreign address).

  • Gather your documents

    Have the following ready before you call: your completed Form SS-4, your LLC's approved Articles of Organization (showing the LLC name and state of formation), your passport, and your personal foreign address.

  • Call the IRS International EIN Line

    Dial 267-941-1099. This line is open Monday through Friday, 6:00 AM to 11:00 PM Eastern Time. This is not a toll-free number — international calling charges apply. Best times to call are 6:00-8:00 AM ET (shortest wait times).

  • Answer the agent's questions

    The IRS agent will ask you questions directly from the Form SS-4. They will verify your LLC name, state of formation, type of entity, responsible party name, and foreign address. The call typically takes 15-30 minutes.

  • Receive your EIN immediately

    The agent will issue your EIN during the call and read it to you. Write it down carefully. The official confirmation letter (CP 575) will be mailed to your registered agent address and typically arrives in 4-6 weeks, but your EIN is valid and usable immediately.

Pro tip: call early

Third Party Designee Process (How We Do It)

The IRS allows you to designate a Third Party Designee to obtain the EIN on your behalf. This is a formal authorization where you sign the Form SS-4 and check the "Third Party Designee" box, granting a named person permission to call the IRS, answer questions about your LLC, and receive the EIN.

Documents You Need

Before applying for an EIN (by phone or through us), make sure you have:

  • Approved Articles of Organization — the filing confirmation from the Secretary of State proving your LLC exists. This includes the LLC name, state of formation, registered agent, and filing date.
  • Completed Form SS-4 — the IRS application for EIN. The critical fields are:
    • Line 1: Legal name of the LLC
    • Line 3: Responsible party name (you, the owner)
    • Line 4a-4b: Mailing address (your registered agent's address works)
    • Line 7a: Name of responsible party's SSN or ITIN (leave blank or write "Foreign" if you have neither)
    • Line 9a: Type of entity — check "LLC"
    • Line 10: Reason for applying — "Started new business"
  • Valid passport — the IRS agent will ask for the responsible party's identification. Your passport number and country of issuance are sufficient.
  • Your personal foreign address — the IRS records the responsible party's home address separately from the LLC's US address.

Your registered agent address is fine for the LLC

The IRS needs a US mailing address for your LLC. Your registered agent's address works for this purpose. The IRS will mail the official EIN confirmation letter (CP 575) to this address. Your registered agent will forward it to you.

Common Mistakes and Rejections

1. Calling the wrong IRS number

The domestic EIN line (800-829-4933) will redirect you or refuse to process international applications. The correct number for non-residents is 267-941-1099. This is the only number that handles EIN applications for people without SSNs.

2. Calling before LLC formation is confirmed

The IRS will not issue an EIN for an LLC that does not yet exist. You must have your approved Articles of Organization before calling. If your LLC is still "pending" with the Secretary of State, wait until it is approved.

3. Inconsistent information

The LLC name you tell the IRS agent must match your Articles of Organization exactly. If your articles say "Global Commerce Solutions LLC" and you say "Global Commerce Solutions" (without "LLC"), the agent may reject the application or create a mismatch. Use the exact legal name.

4. Not knowing your LLC details

The IRS agent will ask about your LLC's principal activity, expected number of employees, estimated first-year revenue, and fiscal year. Have reasonable answers prepared. For most non-resident LLCs: principal activity is "consulting" or "online services," zero employees, estimated revenue under $100,000, and calendar fiscal year (January-December).

5. Applying by mail without patience

If you fax or mail Form SS-4 instead of calling, expect 4-6 weeks for processing. The fax number is 855-641-6935. The mailing address is Internal Revenue Service, Attn: EIN International Operation, Cincinnati, OH 45999. The phone method is strongly recommended — there is no advantage to mail other than avoiding the phone call.

6. Using an EIN application service that takes weeks
